Dr. Jennifer Watson had performed many laser surgeries at Hollywood Grace Hospital. This time, however, she sustained significant injuries while performing surgery on a patient with the laser supplied by the hospital – and sued. Dr. Watson contended that, since her injuries were caused by a laser supplied by Hollywood Grace, that the hospital should therefore be held strictly liable for her injuries pursuant to the rule imposing strict liability upon defendants who place products in the stream of commerce. Hollywood Grace Hospital contended that it primarily provided services, and not a product, to Dr. Watson and therefore should not be held strictly liable for Dr. Watson’s injuries.
